Please read the terms and conditions carefully. By placing an order with Ton Atelier, you agree to the terms and conditions listed below.

General

Please note that by completing the payment process for your order, you expressly acknowledge and consent to the terms and conditions outlined below:

  1. For all screen printed transfers, it is required that all artwork be converted to Pantone colors. In cases where the selected hex color in your file is unavailable as a Pantone color, the closest available color will be chosen.
  2. For all DTF (Direct to Film) transfers, all artwork must be converted to the CMYK color profile. Please be aware that not all colors can be precisely reproduced with DTF transfers, and some variance in shades may occur. Additionally, colors displayed on your computer monitor may differ slightly from the actual print. Minor variations in colors may also be observed in repeat orders.
  3. All uploaded files must adhere to the artwork specifications detailed on the product page. Files provided in low resolution, on non-transparent backgrounds, or in incorrect sizing will be printed as submitted. It is the sole responsibility of the customer to furnish print-ready files. No refunds or reprints will be entertained for files of inadequate quality, non-transparent backgrounds, or incorrect sizing.
  4. All custom orders are final and non refundable.
  5. All custom orders can be redone if there is a quality or damage issue.
  6. Ton Atelier assumes no liability for damaged garments resulting from the application of transfers. It is the responsibility of the customer to thoroughly inspect transfers prior to application. No credits or compensation will be issued for damaged garments.
  7. When applying transfers to multiple garments, we recommend a review of the first completed garment for any issues with the quality of the transfer. For a most complete quality review, a wash and stretch test is also recommended.
  8. Transfers will adhere differently on different fabrics. Test prior to production.
  9. Turnaround time. Order production estimates are provided based on our current production volume and may be subject to change depending on workload fluctuations. Please be advised that these estimates serve as references only and do not guarantee specific shipping dates. It’s important to acknowledge that unforeseen circumstances such as power outages or technical issues can potentially cause delays in production.
  10. Shipping. Shipping services are facilitated through Purolator and UPS. Ton Atelier does not directly deliver orders to customers. Please note that we cannot ensure the accuracy of shipping estimates provided by carriers. It’s essential to understand that shipping dates and production turnaround dates are distinct. Production time refers to the duration required to craft and dispatch your custom order. Following completion of production, the subsequent period is referred to as shipping time or transit time, as handled by the shipping carrier. Production estimate on product pages are for production time only and does not include shipping time.

Replacements & Refunds

  1. To qualify for a replacement, it is necessary that at least 80% of the transfers remain intact and unused. If more than 20% of your order has been utilized, replacements cannot be facilitated.
  2. Requests for replacements must be submitted no later than 14 days following the receipt of your order.
  3. Please note that all custom printed orders are ineligible for refunds; replacements are the only recourse available.
  4. Patches: Once the digital proof for embroidery patches has been sent via email, cancellations are not permitted. Only minor alterations to the design can be accommodated at this stage. Please be aware that significant preparatory work, including the digitization of your custom file, has already been completed from our end. In the event that a refund is deemed necessary, a fee of $45 will be deducted to cover the costs associated with the digitized file and graphic work.
  5. All orders must be thoroughly examined for defects upon receipt of delivery and prior to any alterations or embellishments. Any defects must be reported within 4 days of delivery to be eligible for consideration. Orders examined after this period will be rejected.

All prices are subject to change without notice. Company assumes no responsibility and shall incur no liability whatsoever if price change notices are not received. In the event of new taxes or legislation affecting the cost of Products, Company reserves the right to increase prices as it deems appropriate or necessary. Shipping prices can be increased during the year.

  1. Intellectual Property: All content on our website, including text, images, logos, and designs, is the intellectual property of Ton Atelier or our licensors and is protected by copyright and other laws. You may not use, reproduce, or distribute our content without prior written permission.

  2. Privacy Policy: We are committed to protecting your privacy. Our Privacy Policy outlines how we collect, use, and disclose your personal information. By using our website, you consent to the collection and use of your information as described in our Privacy Policy.

  3. Limitation of Liability: Ton Atelier shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to your use of our website or any products purchased from us.

  4. Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of the province of Quebec. Any disputes arising under these terms and conditions shall be subject to the exclusive jurisdiction of the courts in Quebec.

  5. Changes to Terms and Conditions: We reserve the right to update or modify these terms and conditions at any time without prior notice. Any changes will be effective immediately upon posting to our website. It is your responsibility to review these terms and conditions periodically for updates.
